Inheritance of rights and obligations under a land lease agreement is one of the most common issues in Ukrainian land law. Ukrainian legislation distinguishes between the death of the tenant and the death of the landowner, with different legal consequences for each situation. As a general rule, the death of either party does not automatically terminate the lease agreement.

If the tenant dies, the lease right becomes part of the estate and may pass to the heirs under the same contractual conditions. However, the lease agreement itself is crucial. If it explicitly states that the lease terminates upon the tenant's death or that lease rights cannot be inherited, those provisions apply. Where there are no heirs or they refuse the inheritance, the lease right may pass to persons who jointly used the land and are willing to continue farming it.

If the landowner dies, the lease generally remains valid. The heirs automatically assume the role of the landlord and inherit all rights and obligations under the existing agreement until it expires. The new owner must notify the tenant of the transfer of ownership, and future rent payments are made to the heir. Amending the lease agreement is not mandatory unless both parties choose to do so.

Legal experts recommend carefully reviewing lease terms before signing, as the agreement itself may define how lease rights are inherited. Clearly drafted provisions help prevent disputes between heirs, tenants, and landowners while ensuring uninterrupted use of agricultural land after ownership or tenancy changes.
